SMALL CLAIMS GUIDE

Small claims court in California provides a streamlined process for resolving disputes involving smaller amounts of money. This guide explains the basic requirements and procedures in plain English.

ELIGIBILITY REQUIREMENTS

Who Can File?

  • California residents (individuals or businesses)
  • Claims involving California-based defendants or incidents
  • Plaintiffs at least 18 years old (minors require guardian)

Claim Limits

  • Individuals and sole proprietors: Up to $10,000 per claim
  • Businesses and corporations: Up to $5,000 per claim
  • Maximum filings: No more than 2 claims over $2,500 per calendar year

VENUE SELECTION

You must file your case in the correct court location (venue). Generally, you file where:

  • The defendant lives or has a business address
  • The incident or contract breach occurred
  • Personal injury or property damage happened
  • The contract was signed or to be performed

Tip: Filing in the wrong venue can result in dismissal. When in doubt, file where the defendant resides or conducts business.

FILING FEES

California small claims filing fees vary by claim amount:

Claims up to $1,500$30
Claims $1,500.01 to $5,000$50
Claims $5,000.01 to $10,000$75

Additional fees may apply for service of process ($15-$40) and requesting postponements.

SERVICE OF PROCESS REQUIREMENTS

After filing, you must officially notify the defendant by serving them with court papers. You cannot serve papers yourself—someone else must do it.

Personal Service

Hand-delivering papers directly to the defendant. Most reliable method. Must be completed at least 15-20 days before the hearing.

Substituted Service

If personal service isn't possible after reasonable attempts, papers can be left with a competent adult at defendant's home or business, followed by mailing. Requires at least 25-30 days before hearing.

Certified Mail Service

Available for defendants outside California. Sent via certified mail with return receipt. Must be completed at least 30 days before hearing.

Critical: Proof of service must be filed with the court before the hearing. Without valid service, the case will be dismissed.

HEARING DAY CHECKLIST

Come prepared to present your case clearly and concisely. Bring:

  • All evidence: Contracts, receipts, invoices, emails, photographs, estimates
  • Witness list: Names and contact information (maximum 3-5 witnesses)
  • Organized documents: Chronological order with copies for defendant and judge
  • Written timeline: Brief summary of events leading to dispute
  • Calculation breakdown: Detailed explanation of damages claimed
  • Case number and paperwork: Filed claim forms and proof of service
  • Valid ID: Driver's license or government-issued identification

Presentation Tips:

  • Arrive 30 minutes early to check in
  • Dress professionally (business casual minimum)
  • Address the judge as "Your Honor"
  • Speak clearly and stick to facts, not emotions
  • Keep presentation under 5-10 minutes
  • Answer questions directly and respectfully
